Terms of Service — Tale Companion

Effective date: 25th of September 2026.

These Terms of Service (“Terms”) govern your use of Tale Companion at play.talecompanion.com (the “Service”). The Service is operated by Niccolò Masiero, an Italian sole proprietor trading as Tale Companion (“Tale Companion,” “we,” “us”). You can contact us at help@talecompanion.com.

Please read these Terms before creating an account or making a purchase. The Privacy Policy explains how we handle personal data.

1. What Tale Companion is

Tale Companion is an AI-powered application for creating and playing fictional, user-directed roleplaying campaigns. Its characters, dialogue, narration, and other AI-generated material are generated by AI, not by a human speaking as that character.

The Service is for entertainment and creative use. It is not a therapist, medical professional, emergency service, or source of professional advice. AI output may be inaccurate, inappropriate, repetitive, or inconsistent with your instructions. Do not rely on it for important real-world decisions.

2. Eligibility and accounts

You must be at least 18 years old to use the Service. By creating an account, you confirm that you meet this requirement. You must provide accurate account information, keep your login credentials secure, and tell us promptly if you believe your account has been compromised.

You are responsible for activity through your account unless it results from our failure to meet an applicable legal obligation. You may not sell or transfer your account or use someone else’s account without permission.

We may take reasonable steps to address accounts that appear to belong to people under 18, including restricting or closing them.

3. Private games, publications, and acceptable use

Campaigns and their contents are private from other users by default, unless you choose to publish or share material using a feature that expressly does so. “Private” does not mean end-to-end encrypted or inaccessible to Tale Companion or the service providers needed to store and process it. See the Privacy Policy and the model-selection information for details.

Private fictional games may contain adult themes. We do not routinely have a human read private campaigns to determine whether they contain NSFW material. Nevertheless, you must not use the Service to create, upload, request, distribute, or facilitate:

  • child sexual abuse material or sexual exploitation of minors;
  • non-consensual intimate imagery, unlawful invasions of privacy, or unlawful impersonation;
  • material or activity that violates intellectual-property rights or other applicable law;
  • credible threats, targeted harassment, fraud, or instructions intended to facilitate real-world harm; or
  • attempts to compromise the Service, evade security measures, or abuse its payment or Ink systems.

These rules apply to private as well as public uses. We may investigate specific credible reports, security incidents, or suspected violations, and may access relevant content when reasonably necessary for those purposes or to comply with law. This does not mean that we promise to monitor all private content.

Public content

If you submit a character, story, script, message, campaign setting, lore, file, or other material for publication:

  • you must have the rights and permissions necessary to publish it, including permissions relating to other people’s intellectual property, image, voice, and personal information;
  • you must not publish sexually explicit content, whether text or media, or otherwise unlawful material;
  • you must follow any additional publishing rules shown during submission; and
  • you understand that other users may view and interact with content once it is published.

We may review submissions before publication and may reject, restrict, or remove public content under these Terms or applicable law. Review is not a guarantee that published content is lawful or suitable for everyone.

You can report apparently illegal or rule-breaking public content through the functions on the website or by emailing help@talecompanion.com. Please provide the content’s location and an explanation. We will consider reports and, where applicable, explain restrictions and how to contest them. You can also email us if you believe we made a mistake concerning your content or account.

4. Your content and AI output

As between you and Tale Companion, you retain the rights you have in content you create or upload. We do not claim ownership of your prompts, campaigns, characters, or files. You may use AI output generated for you to the extent permitted by applicable law and relevant model-provider terms; however, we cannot guarantee that an output qualifies for copyright protection, is exclusive to you, or does not resemble another person’s work.

You give us a non-exclusive, worldwide licence, for as long as reasonably necessary, to host, copy, transmit, adapt technically, and display your content to provide and operate the Service, including saving campaigns and sending material needed to process your AI requests. If you choose to publish content, this licence also permits us to display and make that content available through the publishing features until you remove it, subject to residual copies and legal requirements described in the Privacy Policy. You do not give us permission to use private campaigns in advertisements merely by using the Service.

You are responsible for having the rights needed for content you submit. Do not upload sensitive information about another real person unless you have a lawful reason and the necessary permissions to do so.

5. AI models and third-party processing

Tale Companion offers AI models through Cloudflare and, when selected, OpenRouter and its underlying model providers. A request may send the selected model your instructions, relevant campaign context and chat history, and any attachments needed for that request.

Models differ. Some providers may retain inputs and outputs, and some may use them to train or improve their models. We will identify relevant provider data-use information in the model-selection flow. Do not select a model that may retain or train on requests if you do not want the material sent to that provider under those conditions. A model’s availability, price, capabilities, and provider policies may change.

We do not guarantee that a model will follow instructions, produce a particular result, or remain available. Our handling of your personal data—and the limits of deletion once a request has been sent to a provider—are explained in the Privacy Policy.

6. Subscriptions

The available subscription plans, prices, billing periods, included benefits, and daily Ink grants are shown before purchase. Subscriptions are billed through Stripe Checkout and automatically renew at the disclosed interval until cancelled, subject to applicable law.

You can cancel through your billing portal, accessible via the website, or contact help@talecompanion.com for assistance. To avoid the next charge, cancel before the next renewal date. Ordinarily, cancellation stops future renewal, while paid subscription benefits continue until the end of the current paid period. Cancellation does not, by itself, erase Ink already credited to your account.

We will disclose material changes to a subscription’s price or benefits in advance and obtain any agreement required by applicable law. Cancellation of future renewals is different from exercising a statutory right of withdrawal.

7. Ink and AI charges

Ink is the Service’s in-app credit used to pay for AI inference. You may purchase Ink; the Service may also award free or subscription-related Ink. Ink is usable only within Tale Companion. It is not a bank deposit, cryptocurrency, or generally redeemable for cash.

Ink already credited to your account does not expire merely because time passes or you cancel a subscription. Free daily grants are a separate benefit: we may stop making future free daily grants to an account flagged as inactive and not subscribed to a plan, provided the applicable conditions are disclosed in the Service. This does not remove Ink previously credited to that account.

The Ink charge for an AI operation can vary substantially by model, amount of material sent, output length, settings, and other usage factors. Our Ink prices include our own pricing and are not simply a pass-through of what a provider charges us. We will show the applicable pricing information and a pre-generation estimate where the feature supports one, together with the actual Ink charge afterward. An estimate is not a guaranteed final price unless the interface expressly identifies it as a binding maximum. The purchase interface will show the real-money price of an Ink package before you buy it.

We will distinguish purchased Ink from free or promotional Ink in our records. Free Ink is spent before purchased Ink. Ink rates may change prospectively; changes will not retroactively alter charges for completed operations.

8. Refunds and statutory withdrawal rights

Contact help@talecompanion.com for purchase problems or refund requests. We consider requests individually and may grant goodwill refunds, but do not promise a discretionary refund for every request. Nothing in these Terms limits your mandatory consumer rights, including applicable withdrawal rights and remedies for services that do not conform to the contract.

If you are a consumer entitled to withdraw from an online purchase—for example, where an applicable 14-day right applies—you may notify us at help@talecompanion.com. You may identify the purchase and clearly state that you wish to withdraw; you do not need to use particular wording. Information about the applicable right, any lawful exceptions, and any amount payable for performance you expressly requested during the withdrawal period will also be provided before purchase and in your purchase confirmation. Buying Ink does not automatically eliminate a right to withdraw in respect of unused purchased Ink.

If we discontinue Tale Companion or close your account without a breach by you, we will refund the value of your unused purchased Ink and any prepaid subscription period we will not provide, subject to applicable law. Free Ink is not refundable. If we suspend or close an account for a suspected violation, we will not automatically declare unused purchased Ink forfeited; we will assess the circumstances and applicable legal rights.

9. Moderation, suspension, and ending the Service

We may restrict content or suspend an account when reasonably necessary to enforce these Terms, protect users or the Service, respond to a credible report, or comply with law. Where appropriate, we will explain the reason and offer a way to contest a mistake through help@talecompanion.com. Urgent circumstances may require action before we notify you.

You may stop using the Service and request account deletion through the functions on the website. Deletion and retention are described in the Privacy Policy. Ending your account does not extinguish payment obligations already incurred or mandatory consumer rights.

We may change or discontinue features for legitimate operational, technical, legal, or security reasons. If a material adverse change affects a paid service, we will provide notice and the cancellation or refund remedies required by law. We will not use this clause to take away purchased benefits unfairly.

10. Availability, responsibility, and legal rights

We use reasonable care in providing the Service, but AI models, networks, and software may experience errors or downtime. You should retain your own copies of material you cannot afford to lose where an export feature is available.

To the extent permitted by law, we are not responsible for losses caused by an AI answer that you choose to rely on contrary to the warnings above, or by circumstances outside our reasonable control. This does not exclude or limit liability or consumer remedies that the law does not permit us to exclude, including applicable rights concerning digital services.

11. Changes to these Terms

We may update these Terms for legal, security, or Service-related reasons. We will make the current version available on the website and give appropriate advance notice of material changes, including an explanation of the change and any choice or remedy required by law. Changes will not retroactively remove rights you have already acquired.

12. Governing law and disputes

Italian law governs these Terms, without depriving consumers of mandatory protections available under the law of their habitual residence. Courts and dispute procedures will be determined under applicable law; these Terms do not require a consumer to bring proceedings only in Italy if mandatory law provides otherwise.

Please contact help@talecompanion.com first so we have an opportunity to resolve a problem. You may also use any competent consumer authority, supervisory authority, or legally available dispute procedure.
